Buying from outside India
Non-resident Indians and persons of Indian origin may buy residential property in India. The process is the same as for a resident buyer, with a few additional documents.
- Passport and visa or OCI card
- PAN card
- Overseas address proof
- Power of attorney, if you cannot be present to register
Payment
Payment is made from an NRE, NRO or FCNR account, or by inward remittance through normal banking channels. Payment in foreign currency or by traveller's cheque is not permitted.
Power of Attorney
If you cannot travel for registration, a special power of attorney executed in your country of residence and attested at the Indian consulate lets someone register on your behalf.
Tax
Rental income and capital gains are taxable in India, and tax is deducted at source on purchase above the prescribed threshold. Speak to a chartered accountant about your own position.
